Calcutta High Court Questions Speaker Over Recognizing Rebel TMC Leader As LoP

Kolkata: The Calcutta High Court has officially intervened in the escalating political dispute over the Leader of the Opposition in the West Bengal Legislative Assembly. While the court declined to grant an immediate interim stay on the decision of the Speaker to recognize rebel Trinamool Congress legislator Ritabrata Banerjee for the prestigious post, it raised serious legal questions regarding the constitutional boundaries of the move.

Presiding over the crucial hearing, Justice Krishna Rao sought detailed affidavits from all involved parties to examine whether Speaker Rathindra Bose acted within his legal jurisdiction. The judicial bench specifically questioned if an Assembly Speaker possesses the authority to recognize a rebel leader as the Leader of the Opposition without the formal consent of the primary political party. This observation comes after the official party faction fiercely argued that Ritabrata Banerjee had already been expelled from the organization prior to his appointment.

The massive internal crisis within the Trinamool Congress erupted shortly after the recent assembly elections where the party secured 80 seats. The official party leadership, represented by General Secretary Abhishek Banerjee, had originally nominated veteran leader Sobhandeb Chattopadhyay for the position. However, Ritabrata Banerjee openly revolted against the central leadership, claiming the backing of 65 out of the 80 elected legislators. The rebel faction also launched explosive allegations stating that the signatures on the official nomination letter submitted by the party general secretary were completely forged.

Acknowledging the deep division, the Speaker conducted an initial inquiry and officially recognized Ritabrata Banerjee as the Leader of the Opposition on June 3. The Speaker noted in his order that the original resolution submitted by the party leadership was indeed under dispute due to the signature mismatch claims. Currently, the West Bengal Crime Investigation Department is actively probing the serious signature forgery allegations, keeping the political temperatures soaring across the state.

The ongoing legal and political battle has created an unprecedented constitutional situation just as the crucial Budget session of the state assembly commences. With the court scheduling further hearings to thoroughly examine legislative rules and the powers of the Speaker, the final judicial outcome could drastically reshape parliamentary precedents and determine the future of the fractured Trinamool Congress.
