“BJP’s 22 VS Congress’s 77”: Home Minister Contrasts Constitutional Changes

NewDelhi: Home Minister Amit Shah delivered a response, in the Rajya Sabha today during a discussion on amendments in New Delhi on December 17th of the year 2024.His speech highlighted key differences between the BJPs and Congresss strategies, towards constitutional changes throughout the years.

During a speech presentation Shah pointed out that the BJP has been, in power for 16 years and has carried out 22 constitutional changes whereas the Congress party governed for 55 years and initiated 77 amendments, to the constitution.He specifically criticized the alterations done by Congress to the Constitution mentioning the amendment dated June 18th 1951 which took place before either house of Parliament was established.

Shah commented on how the Congress didn’t wait for elections to make changes, to the laws in Prime Minister Jawaharlal Nehrus time by limiting freedom of expression with Article 19A as the first amendment mentioned. He then went on to discuss three amendments during Congress rule. The 24th Amendment (1971) introduced by Indira Gandhi that restricted fundamental rights; the 39th Amendment (1975) which imposed limits, on judicial review of the Prime Ministers office; and the 42nd Amendment that elongated state assembly terms from five to six years.

In support of the BJPs performance record. Shah highlighted four amendments implemented during their leadership.

The 101st Amendment that enforces the implementation of the Goods and Services Tax (GST).
The 102nd Amendment provides recognition, to the National Commission, for Backward Classes.
The 103rd Amendment introduces a 10 percent reservation, for individuals, from backgrounds.
The 105th Amendment grants states the authority to recognize OBC communities.
The 106th Amendment guarantees a 33 percent reservation, for women.
Shah also pointed out changes made by the BJP government such, as the talaq regulation and the new educational policy as well as laws concerning Kashmir related matters.”The introduction of the education policy faced no opposition from the Communists ” Shah remarked. A unprecedented event, in Indian history.

The Home Minister stressed the BJPs dedication to justice through their policy changes. Compared it to what he criticized as the Congresss neglect of the needs of marginalized communities. He specifically pointed out the importance of the Womens Reservation Bill. Expressed hope that its enactment would honor the vision of our Constitutions creators and bring joy to all.

The argument became intense as members of Congress objected to Shahs description of their partys changes. In response, to this criticism he said,”If you have carried out these actions you should also be willing to listen about them.”

The meeting represented a point in discussions that shed light on the continuous conversation surrounding constitutional changes and how they influence Indian democracy. While the BJP focused on their reform driven strategy the opposition stood firm on principles.
