Mumbai: Aryan Khan, son of Bollywood superstar Shah Rukh Khan, on Wednesday moved Bombay High Court minutes after being denied bail by Special NDPS Court in the drugs-on-cruise case.
The court, however, was adjourned before his counsels – senior advocate Amit Desai and Satish Mandeshinde – could present the case to Justice SW Sambre. The case is likely to be mentioned on Thursday, LiveLaw reported.
Special Judge VV Patil declined bail to Aryan, his friend Arbaaz Merchant and Munmun Dhamecha at 2.45 pm.
According to sources, the conspiracy section on Aryan Khan has proved to be a roadblock in granting him bail.
During the arguments in the sessions court earlier, ASG Anil Singh had said, “I have come with a case of conspiracy. In one case if there are 15-20 people involved and it is a case of conspiracy and possession with one accused, then section 37 (of NDPS Act) kicks in. And then stringent conditions against the grant of bail will apply.”
The NCB has reportedly found the mention of a heroine in one of his WhatsApp chats. The use of narcotic lingo and seizure of six and five grams of charas from his friend Merchant and model Dhamecha respectively, also seem to have gone against him.
The trio was arrested on October 3 following a raid by NCB on a Goa-bound cruise the previous day. They have been booked under sections 8(c) read with 20b (purchase), 27 (consumption), 28 (attempt to commit offence), 29 (abetment/ conspiracy) and 35 (presumption of culpable mental state) of the NDPS Act.
Aryan has been lodged in Mumbai’s Arthur Road jail since October 8 and the 14-day judicial custody ends on Thursday.
